1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and OurPart ("OurPart," "we," "us," or "our") governing your use of the OurPart mobile application, website, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements and that you have not previously been suspended or removed from the Service.

3. What OurPart is — and is not

OurPart aggregates publicly available legislative information — bills, legislative actions, votes, and legislator records — and presents it alongside community discussion tools. The Service is provided for general informational and civic-engagement purposes only.

OurPart is not a government entity and is not affiliated with, endorsed by, or sponsored by any government body, legislature, political party, campaign, or elected official. The Service is not an official record of any legislature.

Nothing in the Service constitutes legal, financial, tax, medical, or other professional advice, and nothing in the Service constitutes a voting recommendation or electoral endorsement. You should not make legal, financial, business, electoral, or compliance decisions based on the Service without independently verifying the information against official government sources and, where appropriate, consulting a qualified professional.

4. AI-generated content and legislative data

Portions of the Service — including bill titles, summaries, explanations of legislative actions, topic classifications, and breakdowns — are generated by artificial intelligence and are labeled as such in the app. AI-generated content is produced automatically, without human review of each item, and MAY BE INCOMPLETE, OUTDATED, MISLEADING, OR INCORRECT. It may omit provisions of a bill, mischaracterize legal effect, or reflect errors in the underlying data.

Legislative data is collected from public government sources and third-party providers. It may lag official sources, contain transcription errors, or be revised after publication. Bill statuses, vote tallies, legislator affiliations, and district information are provided on a best-effort basis without any guarantee of accuracy or timeliness.

THE OFFICIAL TEXT AND RECORDS PUBLISHED BY THE RELEVANT LEGISLATURE ARE THE ONLY AUTHORITATIVE SOURCE. To the maximum extent permitted by law, you agree that (a) you will independently verify any information before relying on it; (b) OurPart has no liability for any decision made, action taken, or action not taken in reliance on the Service, including AI-generated content; and (c) your sole and exclusive remedy for dissatisfaction with any content in the Service is to stop using the Service.

The Service provides tools to report AI content you believe is wrong. Reports help us improve the Service, but our receipt or non-action on a report does not create any duty to you or to any third party.

5. Your account

You are responsible for your account credentials and for all activity that occurs under your account. Provide accurate information, keep it up to date, and notify us promptly of any unauthorized use. We may reclaim or require you to change usernames that are misleading, infringing, or offensive.

You may delete your account at any time from Settings. We may suspend or terminate your account as described in Section 12.

6. Your content

The Service lets you post comments, profile information, and other materials ("User Content"). You retain ownership of your User Content. By posting it, you grant OurPart a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt (for example, to format or excerpt it), publish, display, and distribute that User Content in connection with operating, promoting, and improving the Service. This license ends when you delete the User Content or your account, except (a) where the content has been shared with others who have not deleted it (for example, replies quoting you), (b) for copies retained in routine backups for a limited period, and (c) where retention is required by law.

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms, any law, or any third party’s rights, including intellectual-property, privacy, and publicity rights.

User Content is the opinion of its author. OurPart does not endorse, adopt, verify, or guarantee any User Content, and User Content does not represent the views of OurPart. To the maximum extent permitted by law — including under 47 U.S.C. § 230 — OurPart is not liable for User Content or for any interaction between users.

7. Community rules (acceptable use)

OurPart is a place for civil civic discussion across the political spectrum. You agree not to post or do any of the following:

• Harassment, bullying, stalking, or intimidation of any person, including other users, public figures, and legislators;

• Hate speech or discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or similar characteristics;

• Threats of violence, incitement, or glorification of violence, including violence against public officials;

• Sexually explicit content, content sexualizing minors (which we report to authorities), or non-consensual intimate imagery;

• Content encouraging self-harm or suicide;

• Knowingly false or materially deceptive statements about how, when, or where to vote, voter eligibility, or election results, or other coordinated civic misinformation;

• Impersonation of any person or entity, including public officials, or misrepresentation of your affiliation;

• Spam, scams, chain content, undisclosed paid promotion, or commercial solicitation;

• Doxxing or posting others’ personal information without consent;

• Unlawful content or content that infringes any third party’s rights;

• Interfering with the Service, probing or breaching security, scraping at scale, reverse engineering (except as permitted by law), using the Service to build a competing dataset or to train machine-learning models, or accessing the Service by automated means other than public interfaces we provide;

• Circumventing rate limits, access restrictions, subscription requirements, or blocks imposed by us or by other users.

8. Moderation, reporting, and blocking

We provide in-app tools to report comments, users, and AI content, and to block other users. We review reports of objectionable content promptly and act on legitimate reports, typically within 24 hours, by removing content and/or ejecting the offending user where warranted.

We may — but have no obligation to — monitor, screen, edit, remove, or restrict the visibility of any User Content at any time, for any reason or no reason, with or without notice, at our sole discretion. We may also preserve and disclose content and account information where we believe in good faith that doing so is required by law or reasonably necessary to enforce these Terms, protect users, or protect the rights, property, or safety of OurPart or the public.

Blocking another user hides their content from you and severs follow relationships; it does not remove their content for other users. Moderation decisions do not create liability to you or any third party, and our failure to remove particular content does not constitute endorsement.

9. Subscriptions and payments

Parts of the Service are free. Premium features (such as access to bills from every state currently available in OurPart) may require a paid subscription. Prices and features will be shown before you purchase and may change with notice.

Subscriptions purchased through the Apple App Store, Google Play, or a web billing provider are billed by, and subject to the terms of, that provider. Subscriptions renew automatically until cancelled; you can cancel at any time through the applicable store or account-management page, and cancellation generally takes effect at the end of the current billing period. A free trial converts to the disclosed paid plan unless cancelled before the trial ends. Except where required by law or provider policy, payments are non-refundable and there are no refunds or credits for partially used periods. Refund requests for app-store purchases must be directed to the applicable store.

We may change, suspend, or discontinue any feature, including premium features, at any time. If we permanently discontinue a paid feature during your paid period, your remedy is a pro-rata refund of prepaid, unused fees for that feature where required by law.

10. Intellectual property; feedback

The Service — including its software, design, text, graphics, logos, and AI-generated content, but excluding User Content and public government records — is owned by OurPart or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

12. Suspension and termination

We may suspend or terminate your access to all or part of the Service, remove your User Content, or restrict features at any time, with or without notice, if we believe you have violated these Terms, created risk or possible legal exposure for us or other users, or where we discontinue the Service. You may stop using the Service and delete your account at any time.

Sections that by their nature should survive termination (including Sections 4, 6, and 10 through 18) survive.

14. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OURPART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CONTENT (INCLUDING AI-GENERATED CONTENT AND LEGISLATIVE DATA) WILL BE ACCURATE, COMPLETE, OR CURRENT, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) OURPART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (B) OURPART WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM USER CONTENT, THE CONDUCT OF ANY USER OR THIRD PARTY, OR RELIANCE ON ANY CONTENT IN THE SERVICE, INCLUDING AI-GENERATED SUMMARIES AND LEGISLATIVE DATA; AND (C) OURPART’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

THE LIMITATIONS IN THIS SECTION APPLY TO ANY THEORY OF LIABILITY, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Indemnification

You agree to defend, indemnify, and hold harmless OurPart and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: your User Content; your use or misuse of the Service; your violation of these Terms or any law; or your violation of any third party’s rights.

17. Dispute resolution; arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS. You and OurPart agree to first try to resolve any dispute informally by contacting [email protected]; most concerns can be resolved this way within 60 days.

If a dispute is not resolved informally, you and OurPart agree that any dispute arising out of or relating to these Terms or the Service will be resolved by BINDING INDIVIDUAL ARBITRATION administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. The Federal Arbitration Act governs this section.

YOU AND OURPART EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in an individual capacity.

You may opt out of this arbitration agreement by emailing [email protected] with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms; opting out does not affect any other provision.

18. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to Section 17, any claims not subject to arbitration must be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

19. App store terms

If you downloaded the app from the Apple App Store: these Terms are between you and OurPart only, not Apple; Apple has no obligation to provide maintenance or support; in the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing claims relating to the app, including product-liability, regulatory, and IP claims; you represent that you are not located in an embargoed country and are not on any U.S. government restricted-party list; and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. Equivalent terms apply to Google Play where applicable.

20. Changes to the Service and these Terms

We are continually improving the Service and may add, change, or remove features at any time. We may update these Terms from time to time; if we make material changes, we will provide notice in the app or by other reasonable means before they take effect. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Service and delete your account.

21. General

These Terms, together with the Privacy Policy and any additional terms we present for specific features, are the entire agreement between you and OurPart regarding the Service. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship.

22. Contact

Questions about these Terms can be sent to [email protected].
